Donald Trump Says He Would Use Supreme Court To Stop Democrats From Impeaching Him

Robert Mueller‘s report into Russian meddling in the 2016 president election cited ten possible instances of Donald Trump attempting to obstruct justice. Some Democrats, including Sen. Elizabeth Warren, are calling for his impeachment, something Trump claimed he would be immune from on the basis of him having not committed any crimes. On Wednesday, the president followed up on that sentiment by saying he would enlist the Supreme Court’s assistance if the Democrats ever initiated impeachment proceedings.

Scholars say there are no legal grounds for the Supreme Court to intervene in impeachment proceedings, the Constitution freely grants Congress the ability to instigate them. Additionally, a 1993 Supreme Court ruling affirms that the courts do not have the authority to affect the House’s ability to impeach.

In 2009, Brett Kavanaugh, whom Trump nominated to the Supreme Court last year, wrote in the Minnesota Law Review: “If the President does something dastardly, the impeachment process is available. No single prosecutor, judge, or jury should be able to accomplish what the Constitution assigns to the Congress.”
