Andrew McCabe Files Lawsuit Agains DOJ & FBI, Arguing That His Firing Was Trump’s Doing

Andrew McCabe, former FBI Deputy Director, has filed a lawsuit against the Department of Justice and FBI. McCabe claims that he was ousted in 2018 in retaliation by President Donald Trump because of the role McCabe played in the investigation linking Trump and Russia.

The lawsuit claims that firing of McCabe was ordered by Trump. “It was Trump’s unconstitutional plan and scheme to discredit and remove DOJ and FBI employees who were deemed to be his   partisan opponents because they were not politically loyal to him,” the lawsuit reads. 

This lawsuit comes two days after Peter Strzok, former FBI agent, filed a similar suit. He also claims his firing was part of a political retaliation scheme by Trump. He is suing in order to get his job back or compensation. McCabe would like his retirement benefits back.

Both suits contain numerous tweets from the president attacking them for trying to bring him down, claims that the two have rejected. Strzok and McCabe have made their disdain for Trump clear, but both said their political views did not affect their jobs at the FBI. 

McCabe was found by the Justice Department’s inspector general to have misinformed them on a media inquiry during the FBI’s investigation on the use of Hillary Clinton’s private email. 

McCabe’s lawyers note that his firing wasn’t announced until the day before he retired. 

 

The filing states that, “Trump’s repeated public and private statements are direct evidence of Trump’s perception of Plaintiff’s partisan affiliation, Trump’s attribution of Plaintiff’s wife’s political activity to Plaintiff based solely upon their marriage, and Trump’s constitutionally improper motives for removing Plaintiff from the career civil service.”
