Bernie Kerik, the former NYPD commissioner who collected evidence of alleged election fraud for Donald Trump’s campaign in 2020, has struck a deal with Special Counsel Jack Smith to turn over records as part of the investigation into Trump.
During his years-long probe into Trump’s efforts to overturn the results of the 2020 election, Smith sought documents related to Kerik’s role as an investigator for the former president. Kerik’s legal team initially refused to hand over the documents on the grounds of attorney-client privilege, as Kerik was working on behalf of Trump’s former lawyer, Rudy Giuliani.
Kerik agreed to sit for an interview with the House January 6 committee, though prosecutors only received a portion of the documents that Kerik possessed.
However, Trump waived the attorney-client privilege last week and thus Kerik agreed to turn over nearly 2,000 pages of material to Smith describing his probe into election fraud claims.

Kerik narrowly avoided a heavy fine and possible charges from prosecutors and has now agreed to another interview with the federal government, which will take place in mid-August.
The decision to turn over the election fraud investigation documents was made almost a week after Trump’s announcement that he received a target letter from Smith, notifying him that he is a subject in the January 6 investigation.
Though it has been speculated that Smith would indict Trump within the days that followed, the prospect of an interview with Kerik is leading experts to question if he will wait to bring charges against the former president.
