Trump Administration Argues In Court To Allow Employers To Fire Transgender Workers

President Donald Trump’s administration is taking its war on trans rights to the Supreme Court.

Last year, a lower court ruled that a funeral home illegally fired an employee, Aimee Stephens, a women transitioning genders, for wearing clothing that they felt did maintain biological gender roles. The funeral home is owned by conservative Christians who do not support trans rights.

Recently, the Trump administration proposed a law that allows companies who contract with the government fire LGBT individuals under the concept of “religious liberty.”  

The case has been sent to the Supreme Court and will be argued soon. The Department of Justice issued a brief last week saying that the case should be reversed and that the funeral home should be allowed to fire Simpson.

Solicitor General Noel Francisco argued that Title VII only applies if a person is discriminated against based on their  “biological sex.” 

The DOJ also supported the funeral homes owner, Thomas Rost, when he said “the Bible teaches that it is wrong for a biological male to deny his sex by dressing as a woman or for a biological female to deny her sex by dressing as a man.”
