In July, the former Marine filed a lawsuit against Fox News after former host Tucker Carlson repeatedly accused Epps of being a “federal agent who helped stage-manage the insurrection.”

Thousands of people stormed through the Capitol on the afternoon of January 6, 2021, and 1,000 have been charged with crimes related to the conduct.

The video of Epps telling individuals to go into the Capitol and the delayed charge in his case raised questions among conspiracy theorists about whether he might be an FBI agent who was sent to “help stage-manage” the riot.
