The Fulton County grand jury investigating possible 2020 election fraud in Georgia has issued subpoenas to Sen. Lindsey Graham (R-South Carolina) and members of former President Donald Trump‘s legal team including attorneys Rudy Giuliani and John Eastman, according to a new court filing.
This is the first time the investigation, led by Fulton County district attorney Fani Willis, has sought information from members of Trump’s inner circle. Although other investigations like the House select committee’s probe of the events surrounding the January 6, 2021, Capitol attack, have gained national news, this investigation is one of the few that could hold criminal implications for the former president and those who worked closely with him.
Willis’ case is centered around a January 2, 2021, phone call between Trump and Georgia secretary of state Brad Raffensperger in which Trump urged Raffensperger to “find the votes” in Georgia to overturn the election results. The district attorney enlisted a special grand jury which can convene until May 2023 to help with the investigation. Willis has suggested that the investigation will wrap up before then.
The South Carolina senator became involved when Raffensperger interpreted a question asked by Graham as a suggestion he had the power to reject certain absentee ballots. Graham has adamantly denied the statement. The subpoenas seek to find out what exactly was said during two separate phone calls.

“During the telephone calls, [Graham] questioned Secretary Raffensperger and his staff about reexamining certain absentee ballots cast in Georgia in order to explore the possibility of a more favorable outcome for former President Donald Trump,” it read. “[Graham] also made reference to allegations of widespread voter fraud in the November 2020 election in Georgia, consistent with public statements made by known affiliates of the Trump Campaign.”
Giuliani was Trump’s personal attorney at the time and has continued pushing claims of widespread voter fraud.
Eastman is widely credited with coming up with the legal plan to pressure then-Vice President Mike Pence to reject electors in swing states during the certification of President Joe Biden‘s win before the joint session of Congress on January 6 last year.
