Court Dismisses Bid To Block Mary Trump’s Memoir About President By Robert Trump

On Thursday, a New York court dismissed restraining order request against the publication of an expose book by Mary Trump, President Donald Trump‘s niece.

A restraining order against Too Much and Never Enough: How My Family Created the World’s Most Dangerous Man book by Mary Trump was requested by Trump’s brother Robert Trump on Tuesday, citing a nondisclosure agreement from a legal settlement over their father Fred’s will, who died in 1999. Judge Peter J. Kelly of the Queens County Surrogate Court in New York dismissed the case.

“This forum is presumptively improper,” the judge wrote in a four-page order. “It cannot be successfully argued that this dispute affects the administration of the decedent’s estate.”

Charles Harder, the attorney representing Robert Trump and the president, said Robert will reapply for the case.

“Robert Trump, Mary Trump and the other family members who settled in 2001, agreed to jurisdiction of future disputes in the Surrogate’s Court of Queens County, New York,” Harder said in a statement. “This matter therefore was filed in that court.”

Mary Trump’s attorney Ted Boutrous told CNN the request to block the publishing of the book was  “baseless.” “Democracy thrives on the free exchange of ideas, and neither this court nor any other has authority to violate the Constitution by imposing a prior restraint on core political speech,” Boutrous said.

Trump told Axios last week Mary was “not allowed to write a book,” citing the non-disclosure agreement.
