The Biden administration is rolling out tougher laws for people illegally crossing the U.S. border as the government braces for a wave of migrant crossings.
Officials acknowledged that the border patrol faces an uphill battle with growing asylum claims as Title 42 sunsets.
“It’s going to be chaotic for a while,” President Joe Biden said on Tuesday.
Title 42 was a Trump-era immigration order that immediately sent migrants back to their countries of origin instead of hearing asylum claims – the executive action held up in courts as a pandemic-era public safety response.

The new rules make migrants ineligible for asylum claims unless they’ve sought refuge in other countries they have passed through. The administration allowed a carveout for individuals who get a border appointment through the CBP One app.
The administration sent 1,500 active-duty troops to the border last week. The troops are on a 90-day deployment to aid the 2,500 National Guard members already at the border. Defense Secretary Lloyd Austin said the move was necessary because of “an anticipated increase in migration.”
