Daniel Penny, the Marine veteran who was accused of killing Jordan Neely in a New York City subway car in 2023, was acquitted of criminally negligent homicide on Monday, Dec. 9, after a judge dismissed the top charge last week.

A manslaughter charge was dismissed on Friday after jurors deadlocked, according to reports

Dueling protests broke out on Monday outside the courtroom.

Footage from X user @protest_nyc shows protesters calling for justice for Neely, and Gwen Carr, the mother of Eric Garner, speaking to reporters. Eric Garner was killed by an NYPD officer and was one of the incidents that sparked to the Black Lives Matter movement.

“I stood here ten years ago, because they did not give justice to my son, with the chokehold,” Carr can be heard telling reporters.
