It is a sign that few high-profile and familial contacts in the Trump administration are out of reach of Smith. Trump and Kushner were high-level staffers in the White House for the duration of Trump's presidency. Both were in the White House on January 6. They both gave testimony to the House January 6 Committee. During her testimony, Trump said that she believed former Attorney General William Barr's assessment that Trump had lost the 2020 election. Trump and Kushner both said they attempted to dissuade Trump from continuing to spread false information about a stolen election. The filing for Trump and Kushner's testimony comes two weeks after the special counsel subpoenaed former Vice President Mike Pence. Pence has said he will attempt to evade testifying, using the "speech and debate" clause. Then-President Trump called Pence before the Vice President fulfilled his duty to certify Trump's election loss. On the call, Trump pressured Pence to renege on his certification. Pence dismissed the advice. Supporters of Trump could be heard chanting "hang Mike Pence" outside the Capitol walls as the violence ensued. Ivanka Trump tweeted from the White House, pleading for "American Patriots" to end the violence at the Capitol. "Peaceful protest is patriotic. Violence is unacceptable and must be condemned in the strongest terms," she later clarified. Trump and Kushner are not part of Trump's 2024 presidential bid, with the former President saying the campaign would be "too mean and nasty" to the former White House staffers. "There has never been anything like this ‘ride’ before, and they should not be further subjected to it," he wrote on Truth Social.
